LEGAL NOTICE

Notice is hereby given that at the regularly scheduled public meeting of the Board of Commissioners of Manheim Township, Lancaster County, Pennsylvania to be held on Monday, April 11, 2022, at 6:00 p.m. at the Morgan Center, Manheim Township Public Library, 595 Granite Run Drive, Lancaster, Pennsylvania the Board will consider for enactment proposed Ordinance 2022-06 the full title is as follows: ORDINANCE NO. 2022-06. AN ORDINANCE AUTHORIZING AND DIRECTING THE FILING OF A DECLARATION OF TAKING OF A CERTAIN TEMPORARY CONSTRUCTION AND MAINTENANCE EASEMENT FOR THE CONSTRUCTION OF SLOPES, EMBANKMENTS, CHANGING OF WATERCOURSES AND STORMWATER MANAGEMENT FACILITIES AS PART OF A STREAM RESTORATION PROJECT, UPON A PART OF THOSE CERTAIN TRACTS OF LAND LOCATED ALONG OREGON PIKE, EAST DELP ROAD AND VALLEYBROOK DRIVE IN MANHEIM TOWNSHIP, LANCASTER COUNTY, PENNSYLVANIA, AND NOW OR LATE OF RLPS PARTNERS II, LLC; AND AUTHORIZING AND DIRECTING ALL OTHER NECESSARY OR APPROPRIATE ACTION PURSUANT TO THE EMINENT DOMAIN CODE, AND TO ACQUIRE SUCH TEMPORARY CONSTRUCTION AND MAINTENANCE EASEMENT. After providing background to the legal basis for exercising its power of eminent domain to take and obtain a temporary construction and maintenance easement upon a part of the above-mentioned privately-owned properties, the Ordinance authorizes Manheim Township to file a Declaration of Taking pursuant to the Eminent Domain code to acquire such an easement in lieu of condemnation, and to approve and record such plans. A complete copy of Ordinance No. 2022-06 as proposed together with a copy of any related exhibits are available for public inspection and may be examined by any citizen in the office of the Township Secretary, 1840 Municipal Drive, Lancaster, Pennsylvania on regular business days between the hours of 8:00 a.m. and 5:00 p.m. A copy of the Ordinance may also be examined without charge at the offices of this newspaper (LNP) and at the Lancaster County Law Library located at 50 N. Duke Street, Lancaster, PA 17602. The public may participate in the meeting either in-person or virtually. Instructions for participating virtually are posted on the Township’s website (www.manheimtownship.org). The public may contact the Township during regular business hours with any questions.
