[ARCHIVED] Public Hearing Continued for Zoning Text Amendment (Chick-Fil-A)

LEGAL NOTICE

The Board of Commissioners of Manheim Township, Lancaster County, Pennsylvania continued the public hearing at their regular meeting held on Monday, July 25, 2022.  The public hearing will be held Monday, August 22 at 6:00 p.m. at the Morgan Center, Manheim Township Public Library, 595 Granite Run Drive, Lancaster, Pennsylvania to consider the adoption of a text amendment to the Zoning Ordinance of Manheim Township requested by Chick-Fil-A, Inc. At the conclusion of the public hearing or at a subsequent public meeting held within 60 days of the date of the second publication of this advertisement, the Board shall consider enacting and, if appropriate, will take a vote on adopting and enacting proposed ORDINANCE 2022-11, the full title and text of which is as follows: ORDINANCE 2022-11. AN ORDINANCE OF THE TOWNSHIP OF MANHEIM, LANCASTER COUNTY, PENNSYLVANIA, TO AMEND THE ZONING ORDINANCE OF MANHEIM TOWNSHIP 2014, AS AMENDED, TO REVISE SECTION 2409 (D-A AIRPORT

OVERLAY AREA). BE IT ENACTED AND ORDAINED by the Board of Commissioners of the Township of Manheim, Lancaster County, Pennsylvania, as follows: SECTION 1. The Zoning Ordinance of Manheim Township 2014, as amended, specifically Article XXIV (Entitled "T-Zone Overlay Areas"), Section 2409 (Entitled "D-A Airport Overlay Area"), subsection 2.C.(9) (permitted special exception restaurant use) is hereby amended to allow restaurants to offer drive through service as follows: SECTION 2409. D-A AIRPORT OVERLAY AREA 2.C. (9) Restaurants with or without drive through service but with or without outdoor dining. (See Section 2526). SECTION 2. All other provisions of the Zoning Ordinance of Manheim Township 2014, as amended, that are not amended or changed by this Ordinance, shall remain in full force and effect. SECTION 3. In the event any provision, section, sentence, clause or part of this Ordinance shall be held to be invalid, illegal or unconstitutional by a court of competent jurisdiction, such invalidity, illegality or unconstitutionality shall not affect or impair the remaining provisions, sections, sentences, clauses or parts of this Ordinance, it being the intent of the Board of Commissioners that the remainder of the Ordinance shall be and shall remain in full force and effect. SECTION 4. This Ordinance shall take effect and be in force from and after its enactment as provided by law. Copies of Ordinance No. 2022-11 together with any related exhibits are available for public inspection and may be examined by any citizen in the office of the Township Secretary 1840 Municipal Drive, Lancaster, Pennsylvania on regular business days between the hours of 8:00 a.m. and 5:00 p.m. This meeting will be held in-person and virtually. Instructions for participating virtually are posted on the Township’s website (www.manheimtownship.org). The public may contact the Township during regular business hours with any questions.
